1. Acceptance of Terms

By accessing, browsing, registering on, or making a purchase through yakou-store or medicareliv.com (the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and our Return & Shipping Policies. If you do not agree to these terms in their entirety, you must immediately discontinue all use of this Platform.

2. Scope of Offerings & Wellness Disclaimer

The Platform provides access to:

• Yakou Pain Relief Transdermal Patches: All-natural Tibetan herbal formulations formulated for topical, external comfort and soothing relief.
• Telehealth & Digital Health Services (ioliv.in): Technology facilitation connecting users with independent medical practitioners and diagnostics.

3. User Eligibility & Account Responsibilities

Use of this Platform is restricted to individuals who are at least 18 years of age and legally capable of entering into binding contracts under applicable law. Minors may use the Platform solely under the supervision and express consent of a parent or legal guardian.

When you register or place an order, you agree to supply authentic, accurate, and current information. You are solely responsible for maintaining the confidentiality of your account credentials and passwords. Any activity performed under your credentials remains your legal responsibility.

4. Electronic Communications & Notification Consent

By submitting your telephone number, mobile number, or email address on this Platform, you grant express consent to receive electronic communications (including SMS alerts, WhatsApp messages, order updates, invoices, and support correspondence) from us and our verified logistics partners. You agree that this consent overrides any registration under the National Customer Preference Register (NCPR) or "Do Not Disturb" (DND) registries for transaction-related alerts.

5. Orders, Pricing & Payment Terms

• Pricing: All listed prices for products are in Indian Rupees (INR) and are inclusive of applicable goods and service taxes (GST), unless explicitly stated otherwise.
• Payment Verification: Orders may be paid using approved payment instruments, including credit cards, debit cards, UPI, net banking, and authorized payment gateways. By submitting payment details, you warrant that you are authorized to utilize that payment instrument.
• Coupons & Vouchers: Promotional discount codes and membership vouchers are non-transferable, possess zero cash value, and may not be redeemed for physical currency.
• Order Cancellation by Operator: We reserve the right to decline or cancel any order resulting from technical pricing glitches, unserviceable pin codes, or suspected fraud. In such cases, 100% of any charged sum will be promptly credited back.

6. Membership Terms & 14-Day Cancellation

For digital health memberships or recurring subscriptions offered through ioliv.in, subscriptions are billed in advance. A customer is entitled to cancel their subscription within fourteen (14) days of subscription onboarding by emailing customerservice@yakou.store. After 14 days, subscription fees become non-refundable. Physical herbal patches remain subject to our separate 3-day Return Policy.

7. Intellectual Property Rights

All trademarks, trade names, brand assets, packaging graphics, logos (including "Yakou", "Tibetan Herbs", "IOLIV", and "ioliv.in"), text, user interface designs, and photographs displayed on this Platform are the exclusive property of IOLIV Tech Solutions Pvt Ltd and SIDLINK GROUP LTD or their respective licensors.

No part of this Platform may be copied, reproduced, scraped, republished, distributed, or reverse-engineered without prior written authorization from the owners.

8. Prohibited Conduct

You agree that you will not:

• Use the Platform for any unlawful purpose or in violation of local, national, or international regulations.
• Interfere with or disrupt the security, networks, servers, or software hosting the Platform.
• Deploy bots, spiders, scrapers, or automated tools to extract data without express written permission.
• Submit false, defamatory, fraudulent, or infringing feedback or inquiry messages.

9. Limitation of Liability

To the maximum extent permitted by applicable law, neither IOLIV Tech Solutions Pvt Ltd, SIDLINK GROUP LTD, nor their directors, officers, employees, or distributors shall be liable for any indirect, incidental, special, punitive, or consequential damages arising from:

• Your access to, use of, or inability to access the Platform.
• Any delay, failure, or interruption in carrier delivery beyond reasonable logistics control.
• Misuse of topical herbal patches contrary to usage guidelines and precautions printed on the packaging.

In all instances, our total aggregate liability for any claim shall not exceed the actual amount paid by you for the specific product or order giving rise to the claim.

10. Governing Law & Dispute Resolution

These Terms and Conditions shall be governed by and construed in accordance with the substantive laws of the Republic of India. Any controversy, dispute, or claim arising out of or relating to these Terms shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and place of arbitration shall be West Bengal, India, and proceedings shall be conducted in the English language.
